Public PhD defence of Moslem MOKDAD on "Public Procurement of Construction Projects: An in-depth study and comparison of the international practice in Europe, Belgium and Lebanon"

When analyzing the public procurement procedures, the manuscript clearly shows that there is an urgent need for a paradigm shift moving away from contracts awarded by the “lowest price” only, where much evidence has been gathered about its inefficiency. Furthermore, the latest European directives administrating public procurement recommend awarding the contracts to the “Most Economically Advantageous Tender” MEAT instead of the lowest price.


The first aim of this research is to conduct a thorough literature review and critical analysis of the different aspects of the public procurement of construction projects regarding its various techniques, application, pros and cons at the international level and to present a comparison between the procedures in Europe and Lebanon in which we noticed a similarity in the practical procedures between Belgium and Lebanon precisely the wide use of the “lowest price”.

The second objective of this research is to investigate the situation of the public procurement in Lebanon, which has been operating under an outdated public procurement law dated back to 1960, showing numerous deficiencies. With the introduction of a new modern public procurement law in 2021, questions arise about the ability and the requirements of the public procurement process to adapt to these changes and implement new modern techniques.

The key research question of the present thesis is to examine and identify what would be the benefits and what are the obstacles and means to develop and implement the MEAT in the public procurement of construction projects in Lebanon?

The main applied research methodology consists of a questionnaire that has been prepared and addressed to the various stakeholders, like the governmental procuring bodies, the consulting engineers, the bidders (contractors), associations, institutes, etc.

A case study on the reconstruction of the port of Beirut after the dramatic explosion happened in August 2020 has been addressed in this questionnaire with some recommendations for its tendering procedures towards modern procurement and sustainability.
